Membership Terms
Welcome! Thank you for entrusting your child’s swimming journey to us. We strive to provide the best learning environment with purpose-built facilities, small classes, highly qualified staff and excellent lesson content. These membership terms (Terms) help us maintain our high standards for the benefit of all customers. By enrolling your child, you agree to these Terms.
1. About us
‘Born2Swim’ is the trading name of Swim Perth Pty Ltd ACN 609 618 966.
2. Enrolment
As a private facility, every child must be a member to have lessons. Memberships are not transferable.
We cannot hold places without payment. Bookings are only secured once the applicable fees have been paid (see clause 6. Fees). Lessons start the week that you enrol.
Enrolment is ongoing until you complete a cancellation form.
3. Class timings
Your child will attend on the same day and time each week
Classes are 30 minutes, once per week.
We do not swim to terms. Lessons are continuous except for a 2-week break over Christmas. We do not open on public holidays so lessons falling on these days will be credited against your next invoice.
Classes sizes vary between 3 -5 for independent swimmers, and 6 for parent & child groups. If a group lesson has only one (1) or two (2) students in it, we reserve the right to consolidate that class. At least one week’s notice will be provided and we will do our very best to find a suitable alternative class.
We believe that children benefit from the same teacher each week, but we cannot guarantee teacher preference and teachers may change due to sickness/holiday/resignation etc. outside our control.
4. Make Up Lessons
Please refer to full make-up lesson policy attached. The make-up lesson policy forms part of these Terms.
5. Progression
Progress through the swim levels is continuous, your child will be moved up as soon as their teacher determines they are ready (the only exception is a minimum age for some classes).
We encourage parents to:

watch their child’s class;

actively encourage their child;
-
ask the teacher for feedback regularly; and

support the teacher in the event of behavioural issues.
6. Fee
Group Lessons: $22.00 /lesson Private Lessons: $ 50 /lesson Children attending 2 classes per week receive 10% discount. Third and subsequent siblings also receive 10% discount.
We cannot keep class prices low unless we have paying customers in all classes.
For example, if you go on holiday and wish to stop paying for lessons (instead of using the 2 make up classes) your child’s place will be offered to another child.
Lesson prices may increase slightly once per year due to increases in the award rates payable to our teachers, and increased overheads. We will notify you.
7. Payment Options
DIRECT DEBIT VIA PAYRIX
You must complete payment information upon enrolment. Payments are monthly, in advance, on the 1st business day of the month.
The amount = $22.00 x the number of lessons in the month (ie 4 or 5 weeks).
If you enrol part way through a month the first month’s fees are payable upfront with the membership fee, then your direct debit will start on the 1st of the following month.
To cancel, please complete a cancellation form 2 weeks before the end of the month. If we do not receive the form in time to cancel the payment instruction, the following month may be charged.
PAYRIX is an external third-party payment platform. They facilitate the deduction from your bank/card each month, then pay it to us.
Please note any additional fees that are indicated on the PAYRIX form, including a one-off set up fee and fees charged by PAYRIX for declined debits (we have no control over fees charged). Failed Direct Debit payments must be paid for prior to the next scheduled lesson.
We reserve the right to require cancel your lessons if your direct debit repeatedly fails.
8. Cancellations
All cancellations require 2 weeks’ written notice on a cancellation form. Fees already paid are not refundable except in the case of serious illness/injury, supported by a Doctor’s certificate.
Direct Debit payment cancellations require 2 weeks’ notice prior to the scheduled Direct Debit date.
If you are absent for 2 consecutive weeks and we have not heard from you, we reserve the right to remove your child from the class and offer the place to another child.
We reserve the right to cancel your membership if you do not adhere to these terms or if you/your children act in a way that is unsafe around the water.
9. Swim Attire
Swim attire must be worn in the pool, not regular clothes. Bathing suits, bikinis, board shorts and rashies are acceptable. Swim attire must not be removed on pool deck at any time.
Any child who wears nappies must wear a reusable swim nappy for hygiene reasons because faecal incidents can result in pool closure. They can wear the nappy alone, or may wear bathers on top if you prefer.
Although the pool is always heated, and the facility is heated in cooler weather, we recommend that young children bring dressing gowns to keep warm after lessons.
Swimming caps are provided to all independent swimmers. These are recommended but not mandatory, because we realise some children find them uncomfortable.
For parent & child classes, we recommend parents/carers wear a rashie for children to grasp onto. This helps their independence through reaching for/holding the shirt.
10. Your responsibilities
Please help us to provide the best learning environment for your child by following these rules:

Respect the instructions of our staff, their objective is to keep
your child safe

Always supervise your children, including in the play area and
showers.

No food in wet areas (pool deck and change rooms). It’s not
fun for us to clear up soggy crackers!

Tell us if your child has a toilet accident, or spills food/drink
so that we can act quickly.

Keep your child out of lessons for the specified Health
Department exclusion period of two (2) weeks after an incidence of diarrhoea or vomiting or other communicable illness

Be courteous of other parents and children
You must pay your fees on time and update us if your contact details change.
Your child’s fitness to attend swimming lessons is your responsibility. You must inform us if your child has any pre-existing injuries or health issues that may affect their safety in the water, or their ability to learn in a group environment.
All our teachers are trained first aiders. Unless you notify us otherwise, you are deemed to consent to us providing you/your child with first aid if necessary.
This includes calling an ambulance at your expense if you/your child have a medical emergency whilst on our premises.
You indemnify and hold us harmless against any costs, loss, damage or injury in or around the premises. You accept that as we are an aquatic facility, you must take care in wet areas (pool deck, showers etc).
You accept that your belongings are your responsibility, and that you park at your own risk in your car park. We cannot control the actions of other customers.
11. Photo/Video Policy
To be read in conjunction with our privacy policy.
You are welcome to take photos of your own child, but you must avoid capturing photos/videos of other children/parents unless you have their clear consent.
You must stop using your camera, and/or delete any photos or footage of other children if reasonably requested by us.
We occasionally take photos and videos to use for social media and marketing purposes. We will ask your permission before taking any photos/videos if practical. However, if you do not want to have photos or videos taken of you or your child, please inform us on your enrolment form.
Please be aware that we use CCTV at the facility for the safety of all customers.

Make Up Lesson Policy
We are one of the only swim schools to offer the opportunity to make up a missed lesson. Most other children’s activities do not offer this. We view make-up lessons as a gesture of goodwill, because if your child misses a lesson their class still runs and their teacher must still be paid.
The reason we have a make-up lesson policy is to ensure continuity of learning for the students (ie. if they are sick on their lesson day, they can come a different day so as to avoid missing a whole week of swimming).
Sadly our make-up lesson policy has been abused in the past. We want to ensure that everyone has fair/equal access to make-ups. Although the following rules may seem strict, they are absolutely necessary to maintain the system effectively.
We request your understanding and cooperation to help us to make the system work.
Please read on for the conditions that must be met to qualify for a make-up, and the rules that must be followed to use a make-up lesson. Thank you.
Key points:

Make up lessons are not a credit.

Availability on your preferred day/time is not guaranteed.

This make-up policy allows you to request a make-up lesson if you have missed your regular lesson. It does not guarantee that you will receive a make-up lesson if the days/times we have available do not suit you.

The maximum entitlement for all customers is 1 (One) make up lesson per month.

We can only offer you a make-up in an alternative class that has space (eg. due to a child in that alternative class being absent). We cannot create space in your preferred class if there isn’t any. Classes are subject to strict maximum numbers.

Missed lessons CANNOT be:
-
refunded;
-
credited;
-
stored, backed up, saved, held over;
-
transferred to another child;
-
used to reduce a Direct Debit payment.
Make-Up Lesson Policy
Conditions for requesting make-up lessons:

To ‘qualify’ for a make-up, you must notify us in advance via the customer portal and simply pressing cancel, that your child will be absent from their regular lesson. Make-up lessons only work well if everyone notifies us of their absence in advance – if your child is going to be absent we can offer their space to another child needing a make-up session.

Please use the customer portal to cancel your lesson as soon as possible, the system is in 'real time' so you can cancel any time before the lesson starts, or earlier if you know you will be away (eg. if planning a holiday).

If you ‘no show’ for your class, no make-up lesson can be requested as the system will show a 'missed' lesson.
Rules for requesting a make-up:

Use your customer portal to log in and access your account. If you have a make up lessons voucher available you will see the voucher and you can use this to book a make up lesson.

Because of the limited availability we cannot guarantee that there will be a spot available on a particular day/time that suits your own schedule.

Availability relies upon us knowing that other children will be absent due to illness/holidays. We can only offer make-ups in classes which have space – our class sizes are small to ensure effective teaching and we cannot under any circumstances increase class capacity to accommodate make-ups.

You can check availability any time on the portal and see what is available to book into but this is only 7 days in advance. It is possible to look on the day you want to come in and take space recently canceled by another customer.

If the make up class is not used by the expiry date it will be lost.

It is your responsibility to ensure that you use your make-up during the month so that you don’t lose them. This is not the responsibility of the desk staff.

Due to class availability, we may not be able to book a make-up class more than 24 hours in advance.

Make ups can only be booked once – we cannot allow customers to make up a make-up. Therefore if you book a make-up lesson but then cannot make it for any reason, or if you miss it/no show for any reason, the make-up voucher will be taken and cannot be used again.

Doctor’s certificates are required for absences due to illness over 2 weeks.
